To Whom It May Concern:

On 31 December 1996, I submitted two notarized copies of the enclosed ASSEVERATION OF STATUS and SUBSTITUTE W-8 to the payroll clerk where I work, in Charlottesville, Virginia.  I had meant for one to be kept by my employer, and the other to be forwarded to the I.R.S.  These sworn statements ended up on the desk of one Tim Siscoe, Tax Director for Lexis-Nexis, in Dayton, Ohio.

Mr. Siscoe discriminately and summarily rejected my sworn statement of citizenship and substitute W-8, and has refused to implement it.  Not only does Mr. Siscoe believe that he can continue federal withholding, but that I have no right to charge him or sue him for this breach of law.

Please send me a written statement, advising him that:

  1. I am not subject to withholding pursuant to your Publication 515 and my sworn statement.
  2. I am not subject to FICA or MDI withholding under 26 U.S.C. 3101.
  3. He has no legal right to withhold these funds without my consent.
  4. He is acting as a "Withholding Agent", so along with his co-conspirators in Lexis-Nexis Legal Department, is subject to 18 U.S.C. 241 and can be fined up to $10,000 and/or imprisoned for not more than 10 years.
  5. He is liable to me in an action at law, suit in equity, or other proper proceeding for redress, pursuant to 42 U.S.C. 1983.
